New update for Nintendo 3DS consoles today.

Included is an official warning from Nintendo that your console could end up being permanently disabled.

Previously there have been unconfirmed rumours that Nintendo could do this if they detect a flashcard in the system. If I remember correctly, this rumour came from a Japanese launch poster for the console. So this warning takes that a step further, as it is a more official response from Nintendo on the matter.

It is unclear whether this 3DS software update just includes a warning only about things to come, or if it also includes anti-piracy measures of some kind.

The notice from Nintendo may just be protection for them as a company. If your console is damaged in some way by unauthorised equipment like a flashcard, they may refuse to repair it. Or it may also be something more sinister, and imply that they will intentionally disable an offending console.

Personally, I think it's nothing much to worry about - but you should certainly keep this in mind. There is no way for Nintendo to distinguish between someone that only plays homebrew, and another person that obtains their games through piracy.

Compatibility: So far I have heard of at least one other flashcard that still works after this update, but I'm not sure about the CycloDS iEvolution. As it has had no problems with previous updates, I assume that it will still work after this one. Is anyone able to test it for us?

Furthermore such use may lead to injury to yourself or others and may cause performance issues and/or damage to your Nintendo 3DS system and related services. Nintendo (as well as Nintendo licensees or distributors) is not responsible for any damage or loss caused by the use of such devices, software, modifications or non-licensed accessories.

IMPORTANT: After the Nintendo 3DS system is updated, any existing or future unauthorized technical modification of the hardware or software of your Nintendo 3DS system, or the use of an unauthorized device in connection with your system, may render the system permanently unplayable. Content deriving from the unauthorized modification of the hardware or software of your Nintendo 3DS system may be removed. Failure to accept the update may render games unplayable.

For those that are interested, there is a 32-page discussion about the possibility of the 3DS being remotely bricked by Nintendo on GBATemp, but the latest post at the time of me writing this is the 23rd of July - before this 3DS system update.
